If Your Workers’ Compensation Claim Is Denied

A workers’ comp attorney may be able to help you if your claim is denied. There are numerous reasons why you may receive a denial, but in most cases you will need to file an appeal in order to obtain compensation for your job-related injury.

Typical Reasons Claims Are Denied or Compensation is Not Paid

Workers’ compensation was created to help employees pay for basic necessities when they are injured on the job. Disputes often occur over the question of whether the injury actually occurred while the worker was engaged in carrying out the duties of his job. Our attorneys at Schiffman Law Office, P.C. will tell you that employers and their insurance carriers will often dispute a claim if they believe there is any possible ground for doing so, and sometimes when there is no basis at all. Keep in mind that just because an injury occurred during work hours, this does not, in itself, constitute a work-related injury. When a dispute arises, you will need to provide evidence to substantiate your claim, such as a statement from your doctor and/or witness accounts.

Another common reason for denial is that the claim was not filed or presented within the time limits. An employee is required by law to promptly report an injury. The employer, in turn, is required to make a report to the insurance company right away (although there is no penalty for the employer failing to do so). The insurance company or your employer might also argue that your injury is not covered under workers’ compensation, or suggest that your injury was not serious enough to prevent you from working and that compensation is, therefore, not payable.
